The home has suffered a significant amount of damage when it was hit by a tornado in 2016. Florida Statute §404.056(5), deals with environmental standards. The estate will be going into probated and ligation. There is a 3rd part interest in this property along with 5 other beneficiary to the estate. The property has a legal third-party claim of lien, and Lis Pendens on the property. It is my understanding that the property is listed for sale, but I don't believe that heirs and/or creditors have been given proper notice due to the probate action(s). Unless and until a Probate Proceeding has been filed and opened, and a Personal Representative is appointed by the Probate Court, there is no person authorized to sign legal documents on behalf of an Estate. Evidence that is needed that the purported seller has actual authority to sign a contract. The "evidence" would come in the form of a one page document from the Probate Court At this time there is no document present from the Probate Court and there is no person authorized to sign legal documents on behalf of an Estate.
